When recruiting new staff you will often want to check that they’re fit for the job. But you need to be very cautious to avoid discrimination. Use our flow chart to keep on track.

Careful selection

Checking that staff are fit and capable to work safely is a sensible thing to do at recruitment. But since the Equality Act 2010 came into force it’s been quite a difficult task for employers. The Act’s purpose is to prevent discrimination on the grounds of disability. But you also have a duty to protect new recruits from the harm which could be caused by work demands which are unsuitable.
